Terms of Service

These Terms of Service (“Terms”) govern access to and use of the ShiftSnap website, mobile applications, software, and related services (collectively, the “Platform”).

By creating an account, accessing, browsing, or using the Platform, you agree to be legally bound by these Terms. If you do not agree, do not use the Platform.

ShiftSnap Pty Ltd (“ShiftSnap”, “we”, “us”, “our”) operates a digital marketplace that helps hospitality businesses connect with workers for casual and short-notice shifts.

IMPORTANT: ShiftSnap is a technology platform only. Unless expressly stated otherwise, ShiftSnap is not the employer of workers, is not a labour hire provider, and is not a party to arrangements made directly between users.

1. Eligibility

You must be at least 18 years old and legally capable of entering binding agreements.

By using the Platform, you confirm that:

(a) all information you provide is accurate and current;
(b) you are legally permitted to use the Platform;
(c) if you are a worker, you hold all legal rights required to work in Australia;
(d) if you are a business, you are authorised to act for that business.

We may request identity or business verification at any time.

2. About ShiftSnap

ShiftSnap provides a platform where:

(a) businesses may create and manage shift opportunities;
(b) workers may create profiles, apply for shifts, and accept opportunities;
(c) users may communicate, rate each other, and process payments through approved providers.

ShiftSnap does not guarantee:

(a) any minimum number of shifts;
(b) any worker availability;
(c) any business demand;
(d) any level of earnings or hiring success;
(e) that any shift will be filled.

3. User Accounts

You are responsible for your account credentials and all activity under your account.

You must not:

(a) share accounts;
(b) impersonate another person or business;
(c) create false accounts;
(d) misuse verification systems;
(e) use bots, scraping tools, or automation without permission.

We may suspend, restrict, or terminate accounts at our discretion where necessary for safety, fraud prevention, legal compliance, or platform integrity.

4. Business Users

If you use ShiftSnap as a business, you are solely responsible for:

(a) ensuring shift details are accurate;
(b) lawful rates of pay and workplace compliance;
(c) superannuation, tax, payroll, and employment obligations where applicable;
(d) providing a safe workplace;
(e) lawful rostering, breaks, and treatment of workers;
(f) compliance with Fair Work laws, WHS laws, licensing laws, and all other applicable laws.

Businesses must not post misleading, unlawful, unsafe, discriminatory, or fake shifts.

5. Worker Users

If you use ShiftSnap as a worker, you are solely responsible for:

(a) ensuring your profile is truthful;
(b) holding required licences, certificates, visas, and work rights;
(c) attending shifts you accept unless cancelled properly;
(d) performing work lawfully and professionally;
(e) paying your own tax where applicable;
(f) complying with workplace rules reasonably notified to you.

Workers must not submit false credentials or misrepresent experience.

6. User Relationships

ShiftSnap facilitates introductions and bookings between users.

Unless otherwise required by law:

(a) ShiftSnap is not the employer of workers;
(b) ShiftSnap does not supervise work performed at venues;
(c) ShiftSnap is not responsible for workplace conduct of users;
(d) agreements relating to work are primarily between business users and worker users.

Nothing in these Terms excludes rights that cannot legally be excluded.

7. Bookings, Shifts & Cancellations

Businesses may post shifts subject to Platform rules.

Workers may apply for available shifts.

A booking is confirmed when accepted through the Platform.

Users must honour confirmed bookings unless cancelled through approved platform processes.

ShiftSnap may apply warnings, ranking impacts, temporary suspensions, cancellation fees, or other measures for repeated:

(a) no-shows;
(b) late cancellations;
(c) abuse of the booking system;
(d) unreliable conduct.

ShiftSnap may determine cancellation rules from time to time.

8. Payments & Fees

ShiftSnap may charge fees including:

(a) posting fees;
(b) transaction fees;
(c) payout processing fees;
(d) premium features;
(e) subscriptions;
(f) promotional or service fees.

Current fees will be shown in the Platform or otherwise notified.

Fees may change at any time to the extent permitted by law.

Payments may be processed by third-party providers such as Stripe or similar services. Their separate terms may apply.

ShiftSnap may place holds, delay payouts, reverse transactions, or investigate payments where fraud, disputes, chargebacks, errors, or suspicious activity arise.

9. Waitlists, Bonuses & Promotions

ShiftSnap may offer launch bonuses, free shift credits, priority access, referral rewards, or promotional incentives.

Unless prohibited by law, all promotions:

(a) are limited offers;
(b) may be changed or withdrawn at any time;
(c) may have eligibility conditions;
(d) are non-transferable;
(e) have no cash value unless expressly stated.

10. Ratings, Reviews & Trust Scores

Users may rate or review each other.

You must provide honest, fair, and lawful feedback.

We may remove, edit, suppress, or investigate reviews or ratings where we reasonably suspect:

(a) fraud;
(b) retaliation;
(c) harassment;
(d) manipulation;
(e) false statements;
(f) abuse.

ShiftSnap may use internal trust, reliability, or quality scores.

11. Prohibited Conduct

You must not:

(a) harass, threaten, abuse, or discriminate;
(b) create unsafe environments;
(c) bypass the Platform to avoid fees after introductions;
(d) scrape data or copy the Platform;
(e) spam users;
(f) upload malware;
(g) commit fraud;
(h) misuse personal information;
(i) break any law.

12. Anti-Circumvention

If users are introduced through ShiftSnap, they must not intentionally bypass the Platform to avoid applicable fees or protections.

ShiftSnap may recover lost fees, suspend accounts, or restrict access where circumvention is suspected.

13. Intellectual Property

All Platform software, branding, logos, text, systems, and designs are owned by ShiftSnap or its licensors.

You may not copy, reverse engineer, resell, or exploit the Platform without written consent.

You retain ownership of content you upload, but grant ShiftSnap a worldwide, non-exclusive, royalty-free licence to host, display, use, reproduce, and promote such content for operating and marketing the Platform.

14. Privacy

We collect and handle personal information in accordance with our Privacy Policy and applicable privacy laws.

By using the Platform, you consent to reasonable collection, use, verification, storage, and disclosure of your information for platform operation, payments, safety, fraud prevention, and legal compliance.

15. Third-Party Services

The Platform may integrate with third-party tools and providers.

ShiftSnap is not responsible for third-party services, outages, policies, or errors beyond our control.

16. Disclaimer

To the maximum extent permitted by law, the Platform is provided “as is” and “as available”.

We do not warrant uninterrupted access, error-free service, suitability for your purpose, or specific commercial outcomes.

17. Limitation of Liability

To the maximum extent permitted by law:

(a) ShiftSnap is not liable for indirect, incidental, special, or consequential loss;
(b) ShiftSnap is not liable for lost profits, lost income, lost bookings, reputational harm, or data loss;
(c) ShiftSnap is not liable for conduct of other users.

Where liability cannot be excluded, our total liability is limited to the greater of:

(i) fees paid by you to ShiftSnap in the prior 12 months; or
(ii) AUD $100.

Nothing in these Terms excludes non-excludable consumer rights.

18. Indemnity

You indemnify ShiftSnap, its directors, staff, contractors, and affiliates against claims, losses, liabilities, damages, and costs arising from:

(a) your breach of these Terms;
(b) your unlawful conduct;
(c) workplace breaches;
(d) tax breaches;
(e) false statements;
(f) injury caused by your acts or omissions;
(g) disputes between users.

19. Termination

You may stop using the Platform at any time.

We may suspend or terminate access immediately where reasonably necessary for safety, legal, fraud, operational, or reputational reasons.

Clauses intended to survive termination continue after termination.

20. Changes to Terms

We may update these Terms from time to time.

Updated Terms become effective when published on the Platform unless otherwise stated.

Continued use after updates means acceptance.

21. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Users submit to the non-exclusive jurisdiction of courts in New South Wales.
